1. Introduction

Welcome to LightShadeTone ("Company," "we," "us," or "our"). The use of our yacht charter services and our web platform located at lightshadetone.sbs (the "Service") which is provided by LightShadeTone is governed by these Terms & Conditions ("Terms").

By reserving a yacht or utilizing our Service, you consent to adhere to these Terms. Should you object to any part of these terms, you are then disallowed from accessing the Service.

2. Service Overview

At LightShadeTone, we offer an array of top-tier yacht charter services, such as:

• Full-day yacht rentals
• Evening sailing excursions
• Business team outings
• Exclusive gatherings
• Extended charters

Availability of such services may vary and depend on weather conditions. Our right to adjust or cease services at any stage is reserved.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must adhere to the following criteria:

• Have reached the age of at least 18 years
• Supply precise and complete details
• Make the specified deposit payment as noted in your reservation confirmation
• Acceptance of these Terms & Conditions

3.2 Confirmation

Only after payment receipt and our issuance of written confirmation is your booking deemed as confirmed. We maintain the discretion to deny service to anyone.

3.3 Availability

Charter availability is contingent upon the accessibility of the vessel and favorable weather conditions. We will endeavor to meet your requested dates and times as best as we can.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and tax-inclusive unless indicated differently. Note that prices may be subject to alteration without prior notice.

4.2 Payment Schedule

• Deposit: Half of the total charter cost is to be paid at the time of booking
• Final Payment: To be settled 48 hours before the charter sets sail
• Additional expenses (if any): To be paid after the completion of the charter

4.3 Payment Methods

We are open to receiving payments via major credit cards, electronic bank transfers, and certified cheques. All payment proceedings are encrypted and secure.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With over 72 hours before departure: Full refund less any processing charges
• Between 24-72 hours prior to departure: Refund of 50%
• Under 24 hours before departure: The refund is not provided

5.2 Weather Cancellations

In the instance of our captain deeming the weather unsafe, we shall propose to:

• Rebook your charter for the immediate next available slot with no additional fee
• Issue a full refund when rescheduling proves unfeasible

5.3 Mechanical Issues

Should mechanical failures occur with the designated vessel, we will strive to supply an appropriate substitute. If providing an alternative is not possible, a full reimbursement will be issued.

6. Safety and Conduct

6.1 Safety Requirements

All guests on board must:

• Abide by all crew directives
• Use safety equipment as needed
• Disclose any health conditions impacting their safety
• Stay within the areas of the vessel specified for guests

6.2 Prohibited Items

The following items are disallowed on the vessel:

• Containers made of glass
• Controlled substances
• Weapons or firearms
• Excessive amounts of any non-alcoholic beverage
• Pets (except when given permission ahead of time)

6.3 Conduct

Guests must behave respectfully at all times. We hold the right to cut a charter short with no refund if a guest's conduct endangers safety or detracts significantly from the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability strictly to the total amount you paid for the charter. We are not responsible for the following:

• Bodily harm resulting from the negligence of the passengers
• Theft or destruction of personal belongings
• Indirect or punitive damages, as well as any consequential losses
• Delays attributed to weather or situations outside of our control

7.2 Insurance Coverage

Comprehensive marine insurance is in place, covering our vessels and the operations we conduct. It is the responsibility of passengers to ensure they have adequate personal and travel insurance coverage.

7.3 Assumption of Risk

Engaging in our charter services implies acknowledgement of the inherent risks associated with maritime activities, and you accept accountability for your own safety and security.

8. Modifications and Itinerary Changes

Should there be a need for changes to itineraries, or sailing routes or schedules due to factors like safety or weather, we reserve that right. We aim to ensure that comparable alternative arrangements are provided.

9. Force Majeure

We cannot be held accountable for delays, cancellations, or alterations caused by events out of our control, which may include, but are not limited to:

• Extreme weather conditions
• Natural catastrophes
• Regulatory actions by the government
• Shutdown of ports
• Vessel malfunctions

10. Privacy and Data Protection

Your private details are managed in line with our Privacy Policy. Utilizing our services implies you consent to our collection and utilization of information as per the aforementioned Privacy Policy.

11. Intellectual Property

The content available on our web platform, including texts, images, trademarks, and graphics, are protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative materials is prohibited without our explicit consent in writing.

12. Governing Law

The laws applicable in Spain govern these Terms. Any arising disputes shall be handled exclusively by courts located in Barcelona, Spain.

13. Changes to Terms

We have the authority to alter these Terms when necessary. Adjustments will be publicized on our web platform with the date of revision updated. The continued use of our services following alterations signifies your agreement with the new terms.
